Los Angeles Superior Court Judge Craig Karlan has said that Activision is likely to lose its lawsuit over Brutal Legend and that he was against delaying the game.
Activision filed a lawsuit against Brutal Legend developers Double Fine Productions in June, claiming that it still owns the rights to publish the game following a multi-million dollar investment. The publisher wants to delay the game's release, which is now due to launch under Electronic Arts' Partners label this October.

But according to The Associated Press, Judge Karlan has told Activision attorneys that their lawsuit is likely to be thrown out in court.
"I can't say there's a likelihood of success here," Karlan said, though admitted that the case would be a "close call".
Brutal Legend, which stars Jack Black as roadie Eddie Riggs, will probably launch October 16th.
